Delhi High Court Grants Divorce as Allegations of Cruelty by Wife’s Family are Acknowledged
In a divorce case heard by the Delhi High Court, allegations of cruelty against the wife and her family were acknowledged, leading to the approval of the divorce. The court, during the husband’s plea, asserted that the undue interference by the wife’s family constitutes mental cruelty. The petitioner claimed that the wife was unduly influenced by her family, leading to a lack of natural relations with the husband. Despite efforts to improve the relationship over 13 years of separation, the court concluded that there was no possibility of reconciliation.
The Delhi High Court, presided over by Justices Suresh Kumar Kait and Neena Bansal Krishna, highlighted that the wife’s behavior validated the husband’s allegations. The excessive interference in the husband-wife relationship by the wife’s family led to mental harassment for the husband.
The court recognized that the wife had outrightly rejected social and other responsibilities associated with marriage due to her family’s influence. Such conduct was considered mental cruelty towards the petitioner. The court, acknowledging the husband’s plea of mental cruelty, granted the divorce.
