The employees of Rajasthan have received a significant relief as the Rajasthan High Court has once again delivered a crucial decision in favor of the employees. The High Court has ordered the state government to provide the benefit of annual salary increase along with arrears to the employees who retired on June 30. This order came in response to a petition filed by Shambhu Dayal Nagar and others.
According to the Civil Services Revised Rules, 2008
There is a provision to grant annual salary increase to employees on July 1 after completing one year of service. Instead of providing this annual salary increase in advance, it is given after completing one year of service. Therefore, employees who retired on June 30 should also be entitled to this annual salary increase.
The petitioners, represented by advocate Rampratap Saini, informed the High Court that they retired from the position of Gram Vikas Adhikari on June 30, 2021. It has been previously established by the Supreme Court and High Courts that the entitlement to salary increase is not contingent upon whether the employee is in service or not.
In response, the state government argued that the annual salary increase is granted on July 1 every year and is only provided to those employees who are in service. Since the petitioners retired one day prior, on June 30, they are not eligible for the benefit of the annual salary increase.
After hearing both sides
Justice Ganesh Ram Meena’s bench directed the state government to provide the benefit of the annual salary increase to the employees retiring on June 30. Additionally, calculation of the annual salary increase and arrears will also be provided to them.
This decision by the High Court comes as a relief to the retired employees of Rajasthan, ensuring that they receive the benefits they are entitled to as per the established rules and regulations.
